Vendor terms and conditions
By registering as a vendor on Emar Syria and listing your products, you agree to this agreement. Please read it: it sets out what you owe the customer and the platform, and what we owe you.
1. What this agreement is, and who the seller is
Emar Syria is a marketplace, not a shop that buys from you and resells. The contract of sale is between you and the customer, and you are the seller of the product and responsible for it. ("Emar Syria" is a trading name under which the platform operates; the operator's registration details are available on request.)
You authorise Emar Syria, on your behalf, to: list your products, receive orders, collect payment for them — including cash on delivery, which is collected by the courier and not by you — issue approved refunds, and deduct commission and amounts you owe before paying out your balance.
An order becomes binding when Emar Syria confirms it to the customer, normally by phone call. From that moment you must fulfil it at the confirmed price.
Emar Syria handles return requests and disputes, and its decision under this agreement determines what is charged to your account. This does not prevent either party from using available legal remedies.
2. Your account
You must provide accurate business, contact, and payment details and keep them updated. You must have the right to sell your products and provide supporting documents when reasonably requested.
You are responsible for activity on your account and for keeping your login details secure.
3. One policy for every vendor
All vendors follow the same Emar Syria sales and return terms. You may not offer shorter or longer return periods, add return fees, or introduce separate conditions for Emar Syria orders.
Mandatory legal rights and existing binding product warranties remain valid.
4. Products and listings
Products must be genuine, legally supplied, safe, and accurately described.
Listings must correctly show the brand, model, specifications, condition, included accessories, price, and available quantity. Do not describe used, repaired, or refurbished products as new.
Notify Emar Syria immediately if you discover a safety issue, incorrect description, or stock problem.
5. Restricted and prohibited products
You may not list anything whose sale, import, or possession is prohibited under applicable law. Products subject to transport restrictions — lithium batteries, pressurised containers, flammable goods — may only be listed within what Emar Syria and the courier allow.
Emar Syria may hide or remove any listing that breaches this agreement or the law, telling you why.
6. Images, descriptions, and permission to use them
You must have permission to use the images and descriptions you provide.
You grant Emar Syria a non-exclusive, royalty-free licence to host, resize, crop, translate, and display that content, and to use it to list and promote your products — including in advertising and in product feeds sent to third parties such as search engines, shopping platforms, and social platforms.
The licence survives closure of your account only as far as needed for records of past orders and for copies already held by those third parties — not for listing new products.
7. Prices, stock, and orders
Keep prices and stock quantities accurate. Do not request extra payment or change the agreed price after an order is confirmed.
Do not replace an ordered product with another model without the customer's agreement through Emar Syria.
If you cannot fulfil an order, notify Emar Syria promptly. Repeated avoidable cancellations — more than three in a calendar month — may lead to account restrictions.
8. Taxes and invoices
The prices you set are inclusive of any tax you are required to charge, unless the tax is shown separately at checkout. You are responsible for your business taxes and for any invoice or record required by law.
9. Packing and dispatch
Prepare orders within the dispatch deadline shown on the order in your vendor panel, which is two working days from confirmation unless the listing states otherwise. Include all advertised accessories and pack products securely for transport.
Keep reasonable evidence of the product's condition, packaging, and serial number where available.
Do not describe packaging as sealed or unopened if you have opened it. Tell Emar Syria before dispatch if testing requires opening the packaging.
Report delivery problems promptly and cooperate with Emar Syria and the delivery provider.
10. Commission, fees, and payouts
Emar Syria charges commission on the amount the customer actually pays for the product, excluding separately stated delivery charges and separately stated taxes.
The rate that applies to you is set out in the fee schedule attached to your seller agreement and shown in your vendor panel. No other fee applies unless it is in the fee schedule or agreed in advance.
Payouts are made weekly through Sham Cash, covering orders confirmed as delivered with no open dispute. A balance below the minimum transfer amount rolls over to the next payout.
Your balance is held and paid in the currency the order was collected in; where a conversion is needed, at the rate used when the order was confirmed.
You receive a statement showing sales, commissions, refunds, and other agreed deductions.
Commission is reversed for cancelled or fully refunded items. For partial refunds, commission is adjusted to match the amount retained.
If deductions exceed your balance, the shortfall carries to the next payout. If it is still unsettled after thirty days, or you stop selling, it becomes payable on request.
You must not collect payment directly from a customer for an Emar Syria order unless we ask you to. Where we do, the amount must be recorded and remitted within three working days.
11. Returns
Change of mind: governed by the published return policy — the product must be unused, complete, and in its original, unopened packaging. Emar Syria bears the transport cost of such a return, and the customer is charged no fee.
Faulty, or different from its description: accepted for inspection even if the packaging has been opened or the product has undergone correct initial testing. The resulting costs are charged to you where the first-testing failure was reported within three calendar days of the customer receiving the order (the operational guarantee period in section 12). The returned product itself may arrive later.
The customer chooses: opening the packaging to test preserves the right to return a faulty or misdescribed product, and at the same time ends the voluntary change-of-mind option, except where the law requires otherwise.
An approved return must be handed to the courier within five working days of approval, or the request lapses.
A working product cannot be returned simply because the customer has used it for work and no longer wants it. Damage caused by misuse is not covered.
These conditions do not remove legal rights concerning defects discovered later.
12. Operational guarantee
Products must perform their advertised function during correct initial testing within the three-day period.
Switching on alone does not prove that a product works correctly. Its performance must match its description and stated specifications.
The operational guarantee does not promise a long-term repair service. It does not cancel legal obligations or an existing binding warranty.
You must cooperate with fault assessments and respond to an assessment request within two working days. A claim of misuse must be supported by a clear explanation and reasonable evidence. If your response does not arrive within that time, the request is treated as accepted.
13. After the guarantee period — manufacturer warranty
Where a product carries a manufacturer's or importer's warranty, you must state its length and what it covers in the listing, honour it, and accept warranty claims we pass to you.
Emar Syria forwards the claim and follows it up with the customer, but does not carry out repairs or bear their cost. None of this affects the customer's rights under the law.
14. Refunds and return costs
Emar Syria manages customer refunds through Sham Cash, including refunds for orders originally paid in cash, within three working days of receiving and inspecting the product.
Accepted refunds include the returned product's purchase price and related delivery charges. Customers are not charged return, restocking, or refund-transfer fees.
You bear reasonable, documented costs — including transfer fees — caused by a faulty product, incorrect item, inaccurate listing, missing accessories, or inadequate packaging for which you are responsible.
Emar Syria bears transport costs for accepted change-of-mind returns. Delivery damage unrelated to vendor fault is handled by Emar Syria with the delivery provider.
You authorise Emar Syria to deduct approved refunds and costs for which you are responsible from your balance. Every deduction must be explained in your statement, and the same amount will not be charged twice.
15. Complaints and disputes
Emar Syria handles return requests and reviews evidence from both the customer and the vendor. You must cooperate promptly with requests for information and product inspection, within the two-working-day period in section 12.
Emar Syria will explain its decision and any related charges. You may request a review and provide additional evidence within seven days of being told the decision.
Emar Syria may temporarily hold funds related to a disputed order while reviewing the case, limited to the amounts at issue. Unrelated payments continue normally.
This process does not prevent either party from using available legal remedies.
16. Product safety and recalls
If a product turns out to be unsafe or is recalled by its manufacturer, you must tell us immediately, stop selling it, and bear the reasonable cost of notifying customers who received it, recovering the product, and refunding it. Emar Syria may hide the listing and stop shipments immediately, without prior notice.
17. Your responsibility to Emar Syria
You will indemnify Emar Syria against claims, fines, and reasonable documented costs arising from: your product being unsafe, counterfeit, or not as described; its infringement of someone else's rights; your breach of this agreement or of the law; or the content you supplied to us.
18. Limits of our liability to you
We do what we can to keep the platform available and your products listed, but we do not guarantee any volume of sales or that the site will run without interruption.
Our liability to you for any order does not exceed the commission we charged on it, and we are not liable for indirect losses such as lost profit. This does not limit our obligation to pay the balance owed to you.
19. Customer information and conduct
Use customer information only to fulfil orders, provide support, or meet legal obligations. Do not sell it, share it unnecessarily, or use it for unrelated marketing without permission; delete it when your account closes unless the law requires you to keep it, and tell us immediately of any breach of it.
Treat customers and Emar Syria staff respectfully. Do not create fake reviews, mislead customers, or move Emar Syria orders outside the platform to avoid commission.
20. Account restriction and closure
Emar Syria may restrict or suspend accounts for serious or repeated breaches, including counterfeit products, fraud, unsafe products, or refusal to honour valid returns.
Where practical, Emar Syria will explain the issue and allow you to respond. Immediate action may be taken where necessary to protect customers or prevent fraud.
You may stop selling by notifying Emar Syria. Existing orders, valid returns, and outstanding payments must still be settled: your listings are hidden, confirmed orders are fulfilled, and your balance is paid in the first weekly run after any open returns are closed. Account closure does not cancel money owed to either party.
21. Events outside our control
Neither party is liable for delay or failure caused by events outside its reasonable control — security events, closed routes, power or internet outages, banking or currency restrictions, or courier failure. Obligations to pay money already owed survive.
22. Changes to this agreement
Material changes are communicated at least fifteen days before they take effect. Continuing to sell after that date is acceptance; if you do not accept them, you may stop selling before then.
New commercial terms apply to future orders; existing orders remain subject to the terms in force when they were placed, unless the law requires otherwise.
23. Notices
Notices are given through the vendor panel or to the email address or phone number registered on your account, and take effect when sent. You must keep those details current.
24. General
You may not assign this agreement without our written consent. If any provision cannot be enforced, the rest remains in force. Not enforcing a breach is not a waiver of the right to enforce it later.
This agreement, together with the fee schedule and the policies published on the store, is the entire agreement between us about selling on the platform.
This agreement may be published in more than one language; where they differ, the Arabic text governs.
25. Governing law
This agreement is governed by the laws of the Syrian Arab Republic, and its courts have jurisdiction over any dispute not settled amicably. Any provision that conflicts with mandatory law applies only to the extent legally permitted.
